Revisionists and traditionalists appeal to Acts 15, welcoming the Gentiles, for analogies directing the church's response to homosexual persons. John Perry has analyzed the major positions. He faults revisionists for inadequate attention to the Jerusalem Decree and faults one traditionalist for using the Decree literally rather than through analogy. I argue that analogical use of the Decree must supplement rather than displace the plain sense. The Decree has been neglected due to assumptions that Paul opposed it, that it expired, or (...) because Gentiles wanted non-kosher meat. I argue that Paul continued to observe the Torah and supported the Decree, that it has not expired, and that Gentile desire for non-kosher meat is not a firm obstacle. Affirming the plain sense of the Decree, I develop the analogy from Acts 15 to homosexual persons. (shrink)

During the later 1660s Thomas Hobbes clearly believed that he was being targeted by dangerous enemies but to date little evidence has been brought to substantiate Hobbes's claims. This article considers evidence suggesting that Hobbes was in fact in danger from clerical and lay enemies who regarded the elderly thinker as a dangerous ideological threat to church and state. What they did, and how Hobbes responded to their actions, helps us to understand the philosopher's place in the politics of the (...) period, but also helps to explain the timing, nature and purpose of some of his most important later writings. The representation of Neg-Raising in the grammar is a matter of controversy. I provide evidence for representing Neg-Raising as a kind of presupposition associated with certain predicates by providing a detailed analysis of NPI-licensing in Neg-Raising contexts. Specific features of presupposition projection are used to explain the licensing of strict NPIs under Neg-Raising predicates. Discussion centers around the analysis of a licensing asymmetry noted in Horn (1971, Negative transportation: Unsafe at any speed? In CLS 7 (pp. 120–133)).Having provided this analysis, (...) I go on to discuss its implications for the theory of NPI-licensing more generally. In particular, I discuss how the present proposal reflects on von Fintel’s (1999, Journal of Semantics, 16, 97–148) proposal to use Strawson downward entailment in the statement of NPI-licensing principles. This paper proposes that both weak and strong NPIs in English are sensitive to the downward entailingness of their licensers. It is also proposed, however, that these two types of NPIs pay attention to different aspects of the meaning of their environment. As observed by von Fintel and Chierchia, weak NPIs do not attend to the scalar implicatures of presuppositions of their licensers. Strong NPIs see both the truth-conditional and non-truth-conditional (scalar implications, presuppositions) meaning of their licensers. This theory accounts (...) for the puzzling inability, noted by Rullmann and Gajewski, of Strawson anti-additive operators to license strong NPIs, as well as for the effects of Zwarts’s hierarchy of negative strength. In this article, I argue that the later Wittgenstein’s related conclusions regarding the importance of a non-theoretical understanding of human behaviour and the essentially therapeutic function of philosophy can be arrived at without subscribing either to the position that description and explanation are necessarily distinct activities or the idea that language is an inherently rule-based activity operating within determinate conceptual-cultural regimes. I aim to do so by bringing together two figures, A.R. Louch and Roy Harris, both of whom stand within (...) a post-Wittgensteinian tradition, but whose kindred yet hitherto unconnected departures from the orthodoxy of that tradition render their work not only distinctive but all the more compelling for it. I shall try to exhibit the affinity between Louch and Harris by means of an expository discussion of the former’s thesis regarding the role and form of explanation in the social and behavioural sciences, followed by an account of explanation in linguistic inquiry consistent with the latter’s ‘integrationist’ philosophy of language and communication. I will also claim that the thought of both Louch and Harris points towards a form of atheoretical empiricism in the investigation of human action, as well as a broadly therapeutic conception of philosophical and linguistic inquiry respectively. However, I will suggest that such a conception is not necessarily best served by the adoption of an overtly therapeutic rhetoric. (shrink)

We evaluate here the performance of four models of cross-situational word learning: two global models, which extract and retain multiple referential alternatives from each word occurrence; and two local models, which extract just a single referent from each occurrence. One of these local models, dubbed Pursuit, uses an associative learning mechanism to estimate word-referent probability but pursues and tests the best referent-meaning at any given time. Pursuit is found to perform as well as global models under many conditions extracted from (...) naturalistic corpora of parent-child interactions, even though the model maintains far less information than global models. Moreover, Pursuit is found to best capture human experimental findings from several relevant cross-situational word-learning experiments, including those of Yu and Smith (), the paradigm example of a finding believed to support fully global cross-situational models. Implications and limitations of these results are discussed, most notably that the model characterizes only the earliest stages of word learning, when reliance on the co-occurring referent world is at its greatest. This paper addresses two puzzles in the semantics of connected exceptive phrases (EP): (i) the compatibility of EPs modifying noun phrases headed by the negative polarity item (NPI) determiner any and (ii) the ability of a negative universal quantifier modified by an EP to license strong NPIs. Previous analyses of EPs are shown to fail to solve these puzzles. A new unified solution to the two puzzles is proposed. The crucial insight of the analysis is to allow von Fintel’s (Natural (...) Language Semantics 1: 123–148, 1993; Restrictions on quantifier domains, PhD dissertation, 1994) leastness condition on EPs to be imposed at scopes non-local to the surface position of the EP. A general result is derived concerning the truth conditions of sentences in which an existential modified by an EP occurs in the scope of a downward entailing operator. The distribution of EPs is argued to depend on how the leastness condition interacts with other pragmatic strengthening conditions, such as the one imposed on any by Kadmon and Landman (Linguistics and Philosophy 16: 353–422, 1993). The two leading traditions of theorizing about democratic legitimacy are liberalism and deliberative democracy. Liberals typically claim that legitimacy consists in the consent of the governed, while deliberative democrats typically claim that legitimacy consists in the soundness of political procedures. Despite this difference, both traditions see the need for legitimacy as arising from the coercive enforcement of law and regard legitimacy as necessary for law to have normative authority. While I endorse the broad aims of these two traditions, I believe (...) they both misunderstand the nature of legitimacy. In this essay I argue that the legitimacy of a law is neither necessary nor sufficient for its normative authority, and I argue further that the need for legitimacy in law arises regardless of whether the law is coercively enforced. I thus articulate a new understanding of the legitimacy and authority of law. (shrink)

Based on an analysis of a fundamental distinction between metaphors of ’finding‘ versus ’making‘ for the obtaining of new knowledge, a number of constructivist positions in education are discussed and criticised, taking account of earlier criticism particularly by Suchting and by Matthews. Constructivist claims which are denied include the claim that we have no direct access to the world, and the claim that communication is inherently meaningless. What is valuable in constructivism, namely the insistence on active learning, on respect for (...) the pupil‘s own thinking, and on the high priority needed for ideas taught to make sense to pupils, together with the reminder that science is a human product, is important to retain without its additional and ill-founded philosophical baggage. Despite great advances in recent scholarship on the political philosophy of John Rawls, Rawls’s conception of stability is not fully appreciated. This essay aims to remedy this by articulating a more complete understanding of stability and its role in Rawls’s theory of justice. I argue that even in A Theory of Justice Rawls maintains that within liberal democratic constitutionalism judgments of relative stability typically adjudicate decisively among conceptions of justice and is committed to more deeply than to the substantive content (...) of justice as fairness. This essay thus emphasizes the continuity of Rawls’s thought over time and motivates the position that Rawlsian stability is as philosophically significant and distinctively Rawlsian as justice as fairness itself. Recently there has been a somewhat surprising interest among Kantian theorists in the moral standing of animals, coupled with a no less surprising optimism among these theorists about the prospect of incorporating animal moral standing into Kantian theory without contorting its other attractive features. These theorists contend in particular that animal standing can be incorporated into Kantian moral theory without abandoning its logocentrism: the claim that everything that is valuable depends for its value on its relation to rationality. In this (...) essay I raise doubts about the prospects for accommodating animal moral standing within a logocentric Kantianism. I argue instead that the best way to incorporate animal moral standing into Kantian theory is to admit more radical departures from Kant’s position by maintaining that consciousness is a locus of moral standing independent from rationality. I propose that we should attribute moral standing to all conscious animals because the capacity of consciousness is the criterion distinguishing individuals whose well-being generates reasons from individuals whose well-being fails to do so. We need such a criterion because we speak of the well-being of things, such as artifacts and meteorological phenomena, which clearly lack moral standing. Having already argued against the Kantian view that the criterion of moral standing is rationality, I proceed to argue that consciousness is also superior to its other principal rival for the criterion of moral standing: life. On the view that emerges from this discussion, we have obligations to show concern for conscious individuals by treating their well-being as providing us with reasons for action; the view thus endorses the criterion of moral standing typically advanced by utilitarians. On this view we also have a distinct class of obligations to show respect for conscious rational individuals; the view thus endorses the Kantian claim that persons have a distinctive moral status in virtue of their possession of rational capacities. In this essay thus begin to show how a principal insight of each leading approach to modern moral theory may be captured in a unified theory. (shrink)

A debated topic in Avicennan psychology is whether for Avicenna abstraction is a metaphor for emanation or to be taken literally. This issue stems from the deeper philosophical question of whether humans acquire intelligibles externally from an emanation by the Active Intellect, which is a separate substance, or internally from an inherently human cognitive process, which prepares us for an emanation from the Active Intellect. I argue that the tension between thesedoctrines is only apparent. In his logical works Avicenna limns (...) an account where through the internal human process of abstraction accidents accruing to an essence existing in matter are extracted, thus preparing the essence for new accidents emanating externally from the Active Intellect, which make the essence something conceptualized in the intellect. This study, then, outlines the epistemological and metaphysical framework presented in the logical works that underpins Avicenna’s theory of abstraction presented in his psychological works. I then discuss whether punishment can be appropriate for animals of each category, and if so what form punishment may appropriately take for animals of each category. The aim is to illuminate each type of punishment through comparison and contrast with the others. This both forestalls the overintellectualization of punishment which arises from viewing humans as the only paradigm case and forestalls the underintellectualization of human punishment which results (...) from making no essential reference, in an account of human punishment, to the human capacity for specifically critical reasoning. This paper challenges the view that academic professionalism resides in the professional 'autonomy ' of the academic, the 'self-regulation' of academics as an occupational group, and the differential 'status' of academic workers. This still influential notion of academic professionalism, it is argued, leads to institutional stasis. What is required is greater reflexivity by academics in respect of their underlying professional values. In particular the piece challenges the academic community to re-think academic freedom - the bedrock of professional identity within that (...) community - in terms of increased inclusivity: 'freedom for all' rather than 'freedom for academics'. The paper touches on issues relating to practice and organisational structure, but focuses primarily on the need for academics to shift the moral bases of their claim to professionalism. In so doing, it also challenges the post-Dearing consensus that the debate on academic professionalism can be adequately conducted in terms of 'standards' and 'outcomes'. A prime purpose of the paper is to promote debate and discussion by setting a different kind of agenda and by couching that agenda within a different kind of discourse. (shrink)

In this essay I review an underappreciated strand of thought according to which the best Kantian moral theory has less in common with paradigmatically deontological theories and more in common with virtue theories than is standardly maintained. I then argue this program should be continued further, to provide not only a virtue-based account of moral judgment but also a virtue-based account of moral worth. I make a case that this fusion of Kantian theory with virtue theory provides the best account (...) of moral rules, and I close by suggesting that it generates a promising new understanding of moral rights. The claim that corporations are not people is perhaps the most frequently voiced criticism of the United States Supreme Court decision Citizens United v. Federal Election Commission. There is something obviously correct about this claim. While the nature and extent of obligations with respect to group agents like corporations and labor unions is far from clear, it is manifest in moral understanding and deeply embedded in legal practice that there is no general requirement to treat them like natural persons. Group (...) agents may be denied rights to marry, vote, or run for public office. More generally the need to guard against discrimination, the core injustice in racism and sexism, has no direct application to the case of group agents. There is also something obviously incorrect about the claim that corporations are not people. The legal practice of treating some group agents as persons under law is ancient, found already in Roman law at the time of Justinian. In this essay I propose that reflection on this tension reveals that fundamental revision to the doctrine of legal personhood is needed. More specifically I propose that legal personhood be decomposed into at least two elements—standing and liability—and that legal systems reject the principle that an entity possesses one just in case it possesses the other. The import of this change ramifies broadly. Decomposing legal personhood not only enables a satisfactory account of the status of corporations and labor unions, who as such have liability but not standing, it also enables a satisfactory account of the status of those who as such have standing but not liability: severely mentally disabled persons, very young children, and non-human animals with phenomenal consciousness but lacking capacities to understand reasons and justifications. Language and Learning is the latest volume to emerge from the Symposium Hellenisticum conference series. Like its predecessors, this book's alliterative title is a guide to its contents, which in this case examine a range of issues involving the philosophical treatment of language by Hellenistic philosophers (or, in a couple of cases, those preceding or following them), a topic that has been strangely neglected by specialists.
